Recognising the danger to sports integrity originating from manipulation of sports competitions, the Montenegrin Olympic Committee (MOC) is determined to fight to preserve sports integrity, including the protection of clean athletes and fair competition. To that end, and based on Articles 46, 52 and 87 of the Articles of Association of the Montenegrin Olympic Committee (consolidated text, no. 02-59/2-1 of October 7 2019), the Executive Board of the Montenegrin Olympic Committee, at an electronic session of March 9 2022, adopted the Policy aimed at assisting with the implementation of the Olympic Movement Code on the Prevention of the Manipulation of Competitions. Due to the complex nature of this threat, the MOC recognises that it cannot tackle this threat alone, and hence cooperation with public authorities, in particular, law enforcement and sports betting entities, is crucial. The MOC declares its commitment to support the integrity of sport and fight against the manipulation of competitions by adhering to the standards set out in this Policy and the Olympic Movement Code on the Prevention of the Manipulation of Competitions and by requiring their members to do likewise. The following conducts constitute a violation of this Policy: Betting Betting in relation either to: A. a competition in which the participant is directly participating and which was organised by the MOC; B. the Olympic games in which he/she is participating. Manipulation of sports competitions An intentional arrangement, act or omission aimed at an improper alteration of the result or the course of a sports competition in order to remove all or part of the unpredictable nature of the sports competition with a view to obtaining an undue benefit for oneself or for others. Corrupt conduct Providing, requesting, receiving, seeking, or accepting a benefit related to the manipulation of competitions or any other form of corruption. Insider information A. Using inside Information for the purposes of betting, any form of manipulation of sports competitions or any other corrupt purposes whether by the participant or via another person and/or entity. B. Disclosing inside information to any person and/or entity, with or without benefit, where the participant knew or should have known that such disclosure might lead to the information being used for the purposes of betting, any form of manipulation of competitions or any other corrupt purposes. C. Giving and/or receiving a benefit for the provision of inside information regardless of whether any inside information is actually provided. Failure to report and reporting mechanisms A. Failing to report to the MOC or a relevant disclosure/reporting mechanism or authority, at the first available opportunity, full details of any approaches or invitations received by the participant to engage in conduct or incidents that could amount to a violation of this Policy. B. Failing to report to the MOC or a relevant disclosure/reporting mechanism (www.olympic.org/integrityhotline) or authority, at the first available opportunity, full details of any incident, fact or matter that comes to the attention of the participant (or of which they ought to have been reasonably aware) including approaches or invitations that have been received by another participant to engage in conduct that could amount to a violation of this Policy. Failure to cooperate A. Failing to cooperate with any investigation carried out by the MOC or the organisation designated by the MOC in relation to a possible breach of this Policy, including, without limitation, failing to provide accurately, completely and without undue delay any information and/or documentation and/or access or assistance requested by the MOC as part of such investigation. B. Obstructing or delaying any investigation that may be carried out by the MOC or the organisation designated by the MOC in relation to a possible violation of this Policy, including without limitation concealing, tampering with or destroying any documentation or other information that may be relevant to the investigation. In accordance with this Policy, the MOC has the following roles and responsibilities: A. to ensure that all members implement the rules in accordance with the Olympic Movement Code on the Prevention of the Manipulation of Competitions (the Code); B. to require from its national federations to adopt the rules which require from any participant in any contest or event, which has been approved or organised by a national federation or any of its organisations, to be bound by the rules that are in accordance with the Code, as a condition for participation in the contest or event; C. to require, as a condition for membership or recognition, that the policies and rules of the organisation concerned comply with the Code; D. to request from its members to communicate any information that suggests or is concerned with the violations of the rules against manipulation of sports competitions and to cooperate with investigations conducted by any organisation responsible for such investigations; E. to investigate with determination possible violations of the rules against manipulation of sports competitions under the authority of the MOC; F. to cooperate with relevant state bodies and administrations, particularly the Police Administration; G. to promote education on integrity, including the obligation of national federations to carry out integrity-related courses in accordance with relevant educational programmes of international federations; H. to request as a condition for participation in the Olympic Games that the longlisted athletes attend educational programs designed by: the IOC, MOC, an international or national federation; I. to partially or completely suspend financing, during the ban, of any participant who has violated the rules or laws relating to the prevention of manipulation of sports competitions; J. to partially or completely suspend financing of its members or recognised national federations which do not comply with the provisions of the Code. This Policy applies to: Montenegrin Olympic Committee and its members; participants of competitions; other persons under the jurisdiction of the MOC and national sports federations. The MOC will, in the coming period, propose the adoption of the Policy for sports organisations to all sports federations in Montenegro. POLICY (MNE version)
